Amusement Parks are great fun for children and adults. The biggest amusement park in our area is Carowinds. In addition to Carowinds, there are carnivals and fairs all throughout North and South Carolina, where amusement rides are set-up. The owners of these amusement parks and everyone who is in charge has a duty to act with reasonable care in order to protect people who are riding on all of the rides.

Unfortunately, there are times when the design of the ride is not safe. Other times there are malfunctions on a ride that ultimately create harm and injury for the riders. Throughout the years we have handled many cases involving serious injury to individuals who have been injured on a multitude of amusement park rides. Our first concern is for the safety of all of the individuals participating on the rides.

It is important to remember that not all personal injury cases are the result of automobile collisions, oftentimes they involve slips and falls, dog bites, unsafe premises and nursing home abuse caused by the negligence, carelessness, or reckless acts of others.

We are experienced in handling large, complex personal injury cases involving catastrophic injuries, such as brain, neck and back injuries, spinal cord injuries such as paraplegia and quadriplegia, burns, and other severe and crippling conditions.

SAMPLE CASE

A Mecklenburg County resident and patron of Vinnie’s Sardine Grille in Matthews, North Carolina was severely beaten by an off-duty bouncer at the establishment. As a result of the beating at the hands of the off-duty bouncer, the patron suffered severe permanent scaring to the right side of his face and multiple abrasions and lacerations to the rest of his body. A lawsuit was filed against Vinnie’s Sardine Grille for failure to provide a safe premise, negligent training, supervision and negligent handling of the situation in question.

CASE RESULT

This case was heard before a Mecklenburg County jury, wherein, the jury awarded the Plaintiff $5,320.00 USD in compensatory damages and $15,760.00 USD in punitive damages. The Defense appealed the jury verdict to the North Carolina Court Appeals; however, a divided Appeals Court affirmed the ruling, saying that the punitive damages award was proper. Nursing Home Negligence

In the United States today, there are over thirty-six million people above the age of 65. According to statistics, many will need some form of assisted living, whether it is a nursing home, assisted living facility or other elderly facility. Due to the fact that long-term care for the elderly is typically extremely expensive (well over $5,000 per month in many areas), the vast majority of residents go through most, if not all, of their assets in a matter of months and then become eligible for federal Medicaid benefits. Indeed, the cost of over 90% of nursing home residents is paid by Medicaid. As such, almost all nursing home facilities receive Medicaid funds. According to the best available estimates, between 1 and 2 million Americans, age 65 or older have been abused in some way or another. Nursing home residents have patient rights and certain protections under the law.

SAMPLE CASE

An elderly woman was admitted to a nursing home for long term care after being diagnosed with dementia. Shortly after her admittance to the nursing home, she was rushed to the hospital suffering from a severely fractured right hip. The nursing home claimed that the elderly lady fell on her own, causing her own accident. Family of the elderly woman, leery of the nursing homes account of the accident ask the elderly lady if she could remember how she had come to injure her hip. The elderly woman told them that a staff member of the nursing home pushed her down. A subsequent investigation by the Department of Social Services revealed the injury to be a result of “caretaker neglect.”

CASE RESULT

This case was settled prior to filing a lawsuit for a confidential amount.
