SAMPLE CASE
A Mecklenburg County resident and patron of Vinnie’s Sardine Grille in Matthews, North Carolina was severely beaten by an off-duty bouncer at the establishment. As a result of the beating at the hands of the off-duty bouncer, the patron suffered severe permanent scaring to the right side of his face and multiple abrasions and lacerations to the rest of his body. A lawsuit was filed against Vinnie’s Sardine Grille for failure to provide a safe premise, negligent training, supervision and negligent handling of the situation in question.
CASE RESULT
This case was heard before a Mecklenburg County jury, wherein, the jury awarded the Plaintiff $5,320.00 USD in compensatory damages and $15,760.00 USD in punitive damages. The Defense appealed the jury verdict to the North Carolina Court Appeals; however, a divided Appeals Court affirmed the ruling, saying that the punitive damages award was proper.
